(“Flowhue”, “we”, “our”, or “us”) and any individual or entity (“User”, “you”) who accesses or uses https://flowhue.art (“Website”). 3. Account Registration

Flowhue reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive activity.

4. Purchases, Payments & Credits

4.1 Payment Processing

Payments are processed exclusively through Stripe.
By making a purchase, you authorize Flowhue and Stripe to charge your selected payment method.

4.2 Credit Packs

Purchases of credit packs are governed by the Refund & Cancellation Policy, including:

Credits are prepaid digital licenses;
Credits expire twelve (12) months after purchase;
Expired or unused credits are non‑refundable.

4.3 Subscription Plans

Subscription purchases renew automatically unless canceled. Unused subscription credits expire at the end of each billing cycle. No prorated or partial refunds are provided once a billing cycle begins.

5. Licensed Content

All images purchased or downloaded from Flowhue are governed by the Flowhue Universal License Agreement.
By downloading or using any content, you agree to comply with all license restrictions and permitted uses detailed in that Agreement.

Flowhue retains all ownership, copyright, and intellectual property rights in its content.

6. Prohibited Conduct

Users may not:

Redistribute, scrape, or reproduce Website content except as permitted under license;
Attempt to bypass credit systems, subscriptions, or digital protections;
Upload malicious code or attempt unauthorized access to the Website;
Use the Website for unlawful, defamatory, hateful, harmful, or abusive purposes;
Misrepresent or claim ownership of Flowhue’s content as original personal creation;
Use content to train, refine, or develop AI or machine-learning models without written approval.

Flowhue may suspend or terminate accounts engaging in prohibited activities.

7. AI‑Generated Content Disclosure

Flowhue’s digital artworks are generated using AI‑assisted workflows combined with human‑led curation, editing, composition, or refinement.
Flowhue asserts copyright and exclusive rights over the final creative output as permitted under applicable law.

Users acknowledge that:

AI‑generated content may contain fictional elements or characters;
Any resemblance to real individuals, brands, or entities is coincidental unless explicitly stated.

8. Intellectual Property

All Website content—including images, design, trademarks, text, software, and branding—is the exclusive property of Flow Hue Digital Media Ltd. or its licensors.

Nothing in these Terms transfers ownership rights to you.

Unauthorized use may result in legal action.

9. DMCA / Copyright Claims

If you believe that content on the Website infringes your rights, please contact us at:

Include:

Identification of the work claimed to be infringed;
A description of the infringing material;
Your contact information;
A statement of good‑faith belief;
A statement under penalty of perjury regarding accuracy.

Flowhue will investigate and take appropriate action.

10. Termination

Flowhue may suspend or terminate your access to the Website if:

You violate these Terms,
Engage in fraudulent or abusive behavior,
Misuse licensed content, or
Attempt unauthorized access or manipulation of systems.

Upon termination, your right to access or use purchased digital content may also cease if such misuse violates licensing terms.

11. Warranty Disclaimer

The Website and all content are provided “as is” and “as available”, without any warranty—express or implied—including warranties of merchantability, fitness for a particular purpose, accuracy, or non‑infringement.

Flowhue does not guarantee uninterrupted availability or error‑free performance.

12. Limitation of Liability

To the maximum extent permitted by law:

Flowhue shall not be liable for indirect, incidental, consequential, punitive, or special damages;
Flowhue’s total liability for any claim arising from use of the Website shall not exceed the amount paid for the specific content or subscription giving rise to the claim.

Some jurisdictions do not allow exclusion of certain liabilities; in such cases, the limitation applies to the fullest extent permitted.

13. Indemnification

You agree to indemnify and hold harmless Flow Hue Digital Media Ltd., its officers, directors, and employees from any claim, loss, damage, or expense arising out of your:

Misuse of licensed content,
Breach of intellectual property rights.

14. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the Province of British Columbia, Canada, without regard to conflict‑of‑law principles.

All disputes shall be resolved exclusively in the courts located in the Province of British Columbia, Canada.
